What is a Lasting Power of Attorney?
A Lasting Power of Attorney is a legal tool which allows someone to appoint a person (or more than one person) to act as their attorney. An attorney will be able to make decisions for a person should they be incapable of doing so themselves.
There are two types of LPA:
– Property and Financial LPA
– Health and Welfare LPA
Why is making a Lasting Power of Attorney important?
Although most people are aware of the importance of making a Will, the need for a Lasting Power of Attorney can be overlooked.
It is often difficult for us to consider what might happen should we become unable to manage our own affairs. However, one of the most important aspects of a Lasting Power of Attorney is to plan for your future whilst you are still in good health.
For many people, it is reassuring to know that a person whom you trust can make decisions on your behalf.
If you do not have an LPA, a friend or relative may need to apply to the Court of Protection to become your Deputy. This can often be incredibly costly and time consuming, leading to difficulties in paying bills or making decisions relating to your future care.

How will our solicitors help you draft your LPA?
Attempting to register an LPA which contains any errors may result in it being rejected and can quickly become costly.
In order for your LPA to be valid, you must show that you have the mental capacity to make the LPA. A ‘certificate of capacity’ form must be signed by a professional such as your doctor, a social worker or a solicitor.
By discussing your circumstances with the specialist solicitors at Future Planning Solutions, you can have peace of mind knowing that your LPA will reflect your needs and wishes. This could include who you would like to act as your attorney and how you would like them to manage your affairs.
Our aim is to make the process of making your Lasting Power of Attorney as hassle free as possible.
